My husband and I recently moved back to Florida from Las Vegas and had to get our prescriptions refilled locally. I feel we were treated VERY prejudicial and unfairly. Upon entering the exam room, 3 hours late and with a dog in the office, the “doctor” proceeded to lecture us about heroine (we both have to take pain killers for existing and verified problems) He didn’t once ask us what the diagnosis was, what our symptoms were, he wouldn’t look at us at all, he discussed the woman he had seen before us with us, in turn disclosing her medical problems with us, thus violating the doctor/patient confidentiality. After our lecture he tried refusing to write our prescripts, even though we were current with them and had brought all our records to confirm the problems. I understand that there are quite a few people “faking” to get narcotics to get high, but my husband and I went through countless tests in Las Vegas to come to a conclusion on our diagnosis. Which, of course, can only be fixed through two very expensive surgeries
My question is this: Where can I find laws or answers that can help me determine if we have a case for malpractice. We both left the office feeling violated, he even raised the price of our visits by $ 40/each!

The kicker of the whole thing is that my husband and I are Tattoo professionals and feel that this doctor looked at nothing but the tattoos, not even the MRI’s, past treatment records, nothing. He just jumped to the conclusion that we are drug addicts based on us being heavily tattooed.

We are professionals and have been in the body art trade for 15+ years. I feel discriminated against and so does my husband.

To top all of that off, he wrote us our prescriptions for one week and when we took them to 3 different pharmacies, none of them could fill them because mine were written wrong and they had no idea what medications were to be filled since the dosage was incorrect and he refused to put his DEA number on the prescriptions, as is required by law.

When we went back to his office to attempt to have the corrections, he refused and called the police siting that we were trespassing.

We spent three hours at that office, like I said, and with a dog there, we were treated like junkies even though neither of us have a history of drug use, and with one of the medications I take being for anxiety, I ran the risk of serious damage, such as seizures and panic attacks if I couldn’t get these meds filled.

Also, one other reasons we had set this appointment was because my husband had a seizure on the way to Florida from Las Vegas and we wanted to have that checked out. The doctor did nothing for us but accuse us of trying to steal his DEA number and accuse us of being junkies.

I don’t know where to start! We are not vindictive people, but agree that this man has no right to be practicing medicine. We would like to file a formal complaint and take him to court in order to get our office fee back and compensation for all the hassle with the prescriptions, the seizures, and just the feeling of being discriminated against. We both feel traumatized from the office visit and the doctor and don’t want anyone else to have to go through this with him.

Could someone please email me and let me know what to do here? Like I said, I’m not vindictive, but everything that happened in the course of that visit is screaming to me and my husband to not let this go.

I tried calling local lawyers, Winters and Yonkers, here in Florida. they just said they couldn’t take the case and gave no reason. I guess I’m really asking if I have a case or not, but you’re right, I should be calling lawyers, but it’s Sunday and I wanted to get some opinions here first. thanks!

Don’t you think the best place to start would be with a competent attorney that specializes in malpractice lawsuits. Check your phone book or phone the Bar Association for a recommendation – it won’t cost you anything.
