Drugs are outlawed by the federal government and therefore all states have (in theory) the same drug laws. Some states chose to add additional charges.

the punishment is truly up to the judge, so it can fluctuate even within the same county depending on the judge.

Edit: Nevada has had decriminalization of Marijuana, and is a misdemeanor if you are an adult. Other states like Louisiana, and Mississippi consistently jail people convicted of possession of weed.
